Binding Legal Agreement
These Terms of Service constitute a legally binding agreement between you and our organization governing your access to and use of our platform. By creating an account or accessing our services, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms, you must discontinue use immediately. These terms apply to all users including individuals, businesses, and enterprise customers.
Acceptable Use Policy
Users must comply with all applicable laws and regulations. Prohibited activities include: unauthorized access attempts, distribution of malware, spamming, copyright infringement, harassment, data scraping without permission, and resource abuse. Violations may result in immediate account suspension. We reserve the right to monitor usage and enforce compliance.
User Responsibilities
You are responsible for maintaining account security, all activities under your account, content you publish, compliance with export controls, payment obligations, and backing up your data. You must immediately notify us of unauthorized access. Account credentials may not be shared. Enterprise customers must designate authorized administrators.
Intellectual Property Rights
All platform content, features, and functionality are owned by us and protected by international copyright, trademark, and patent laws. Users retain ownership of their content but grant us license to host and display it. You may not copy, modify, distribute, or reverse engineer our software. API usage subject to separate licensing terms.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. Our total liability shall not exceed fees paid by you in the 12 months preceding the claim. Services provided 'AS IS' without warranties. Enterprise customers may negotiate separate liability caps.
Dispute Resolution
Any disputes shall be resolved through binding arbitration under AAA Commercial Arbitration Rules. Class actions waived. Arbitration in Delaware, USA unless otherwise agreed. Enterprise customers may opt out of arbitration within 30 days of contract signing. Small claims court available for qualifying disputes. Attorneys' fees awarded to prevailing party.
